Deadlines are unforgiving
Statutes of limitations generally give you 2 years from the date of injury to file a personal injury lawsuit in California or Guam. Claims against government entities follow different, shorter procedures: in California, a government tort claim must generally be filed within 6 months. In Guam, claims against the Government of Guam require a separate administrative claim, generally filed within 18 months after the claim arises, under the Guam Government Claims Act (5 GCA § 6106). Additional deadlines govern when a lawsuit may be filed following the government's rejection of a claim or its failure to act. These procedural deadlines are different from ordinary injury-claim deadlines and easy to miscalculate — confirm yours with a licensed attorney immediately; do not rely on this website to calculate it.
Guam personal injury claims are also subject to a modified comparative-negligence rule (not "pure" comparative negligence): your compensation is reduced by your percentage of fault, and you generally cannot recover if your negligence is greater than the negligence of the party you are suing (i.e., you're barred at 51% or more at fault). See Duenas v. Yama's Co., 999 F.2d 542 (9th Cir.), which expressly rejected pure comparative negligence for Guam.
